Part One

Employment Contracts β€” Know What You Are Signing

Under Federal Decree-Law No. 33 of 2021, unlimited contracts have been abolished in the UAE. Only fixed-term contracts are permitted, and all contracts must be electronically registered with the Ministry of Human Resources. A single ambiguous clause in your salary structure, termination provisions, or non-compete can cost you months of your entitlements.

What We Review in Your Contract

  • 01Contract type and compliance with electronic registration requirements
  • 02Salary structure: the difference between basic and total salary β€” directly impacts your gratuity calculation
  • 03Probation period β€” legally cannot exceed 6 months under UAE law
  • 04Non-compete and non-solicitation clauses β€” their enforceability and potential to challenge them
  • 05Termination mechanisms: notice periods, permitted grounds, and applicable compensation
  • 06Confidentiality clauses and intellectual property provisions
  • 07Governing jurisdiction: UAE mainland law, DIFC or ADGM?

Most employment contracts in the UAE are drafted in English, but legal proceedings are conducted in Arabic. In the event of a conflict between both versions, the Arabic text may take precedence. Always review both language versions before signing.
